Terms and Conditions - Dine-In (DH Pakistan)
1. Dine-In
Dine-In is part of the pandapro programme implemented by Delivery Hero Pakistan Limited (“foodpanda”, “we”, “our” or “us”) where pandapro members (“members” or “you”) are entitled to various offers and benefits that may be redeemed when dining in at participating restaurants (“Offer” or “Offers”).
These rules of use (“Rules”) govern your use and redemption of an Offer. You agree to be bound by these Rules when redeeming an Offer.
2. Eligibility
Only members with valid pandapro subscription plans are eligible to redeem Offers.
The pandapro Subscription Terms and Conditions shall continue to apply and are incorporated by reference herein. A copy of the pandapro Subscription Terms and Conditions may be accessed in the foodpanda app or on our website (“Platform”).
3. How to redeem your Offer
You can access your Offers by clicking on the “Dine-in” tab on the Platform. You may find out more information about the Offer (including the Offer’s validity period, the number of times you can use the Offer, the participating restaurant’s valid hours and other Offer-specific terms) by clicking on each Offer.
To redeem an Offer, follow the in-app instructions and prompts to complete the redemption.
Please inform the participating restaurant that you intend to redeem an Offer before the bill has been generated.
Once an Offer has been successfully redeemed, it is non-refundable.
Membership can only be used on the single device and may not be used on multiple devices with a single registered email.
In the event of any difficulty or disagreement over an Offer redemption (for example, where there is an error in redeeming the Offer on the Platform or where the participating restaurant refuses to honour a valid Offer), please contact our customer service through the Help Centre available on the Platform.
You are responsible for all service charges and taxes, if any, which may result from your redemption or use of an Offer. Please check with the participating restaurant directly for more information.
4. Validity of Offers
Offers can be used for dine-in only. Unless specified otherwise, Offers are not valid for delivery or pick-up. To ensure table availability, reservations are encouraged.
Offers can only be redeemed at participating restaurants during the stated validity period.
Unless otherwise specified, Offers can be used daily at any time during a participating restaurant’s valid hours and at its specified location(s).
Offers cannot be used in conjunction with any other discounts, Offers, promotions, off-the-menu item(s), or loyalty/rewards programs in the participating restaurant.
Offers are not exchangeable for cash. Offers shall only be redeemed and used in the manner set out in these Rules. You shall not sell, modify, distribute, transfer or Offer with any Offers for profit or otherwise. Offers are void if resold or bartered.
Offers must be personally used by members. Members must be physically present at the time of Offer redemption. The participating restaurant may request for your identification card to verify your identity.
Unless specified otherwise, % discount offers will be applicable on all a la carte/ regular menu items except discounted combo menus and special priced items. Please check directly with the participating restaurant for more information.
For one-for-one Offers, the lowest priced item (as listed on the Offer) will be deducted from your bill. The two items must be from the same category as indicated on the Offer.
One-for-one offers will be applicable on the specified category or the full menu (as listed in the offer) except for discounted combo menus, special priced items or platters
Offers providing a discount will be applied on your total bill value. For example, an Offer offering a 25% discount will mean 25% off the total value of the items ordered (excluding all service charges, taxes and other charges, as applicable).
No minimum order value is applicable for Offers, unless otherwise specified.
For % discount on the total bill, there is no restriction on the minimum or maximum number of people per group that can redeem an Offer.
All offers are not applicable for pitchers/ jugs/ towers/full bottles and across happy hour for drinks
% discount benefits are not stackable, maximum of 1 redemption per table (no splitting of bills are allowed).
Unless otherwise specified, there is no restriction on the number of participating restaurants that you can redeem Offers at in a day.
foodpanda reserves the right to remove and/or amend an Offer at any time and in its sole and absolute discretion. To the extent permitted by law, foodpanda, its agents, representatives and service providers shall not be liable to you for any loss or damage including loss of business, revenue or profits, or any indirect or consequential loss whatsoever, arising out of or in connection with the removal or amendment of any Offer.
5. Governing law and Dispute Resolution
These Rules shall be governed by and construed in accordance with Pakistan without regard to any conflict of law rules.
Any dispute, claim or difference of any kind whatsoever arising out of or in connection with these Rules shall be subject to amicable dispute resolution through arbitration and the seat of arbitration shall be Karachi.
6. General
foodpanda shall not be held responsible for any problems with the network, software or any breakdown or failure that adversely affects your redemption of an Offer.
foodpanda is not responsible or liable for any failure of any participating restaurants to fulfil its representations or promises in respect of any Offer, for any reason whatsoever. The participating restaurant is solely responsible for the preparation, condition and quality of items purchased using an Offer.
Nothing in these Rules is intended to, or shall be deemed to, establish any partnership or joint venture between us, nor make you or us the agent of one another for any purpose.
In the event that any provision of these Rules is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Rules, such determination shall not affect the validity and enforceability of any other remaining provisions.
7. Prevailing Language
In the event of a dispute as to these Rules, the English version shall prevail. The English language version of these Rules shall control in all respects and shall prevail in case of any inconsistencies with translated versions.
